In these Terms and Conditions, the following words carry the meanings set out below:
- "We," "Us," "Our" — mitsahax Advocates, a family law mediation practice registered and operating in Bangkok, Thailand.
- "Service" — the family mediation, caregiver coordination, and family settlement services described on this website, as well as the website itself.
- "User," "You," "Your" — any individual or entity accessing this website or engaging our services.
- "Agreement" — these Terms and Conditions together with our Privacy Policy and Cookie Policy.
- "Content" — all text, materials, documents, and information published on this website.
- "Session" — a scheduled mediation appointment or coordinated service engagement, as described in a written service confirmation.
2. Acceptance of Terms
By accessing this website or engaging our services, you confirm that:
- You are at least 18 years of age or have the legal capacity to enter into a binding agreement under Thai law.
- You have read these terms and accept them without reservation.
- Where you are acting on behalf of a family group or organisation, you have authority to bind that group to these terms.
If you do not agree with any part of these terms, please do not use this website or engage our services. You are welcome to contact us with questions before proceeding.
3. Service Description
mitsahax Advocates provides private family mediation and coordination services in Bangkok, Thailand. Our current service offerings include:
- Family Mediation Session — a single structured mediation session held in chambers or remotely, 4,800 THB.
- Sibling Caregiver Coordination — a coordinated service for adult siblings sharing responsibility for an older parent, 7,600 THB.
- Multi-Party Family Settlement — a comprehensive service for families with several connected matters, 12,500 THB.
Services are available to clients in Thailand. We reserve the right to decline engagements that fall outside our practice area or where we determine that mediation is not appropriate in the circumstances.
Service descriptions are for general information only. Specific scope, deliverables, and timelines are confirmed in a written service agreement provided before each engagement begins.
4. User Responsibilities
When using this website or engaging our services, you agree to:
- Provide accurate and complete information at the time of enquiry and throughout the engagement.
- Attend scheduled sessions at the agreed time or give reasonable notice if attendance is not possible.
- Treat other participants and our team members with courtesy and respect at all times.
- Keep confidential any information shared by other family members during the mediation process.
- Not use this website to distribute unsolicited communications or to attempt to gain unauthorised access to any part of our systems.
- Comply with all applicable Thai laws in connection with your use of our website and services.
5. Intellectual Property
All content on this website — including written text, layouts, graphics, and document templates — is the property of mitsahax Advocates and is protected under Thai and international intellectual property law.
You are granted a limited, non-exclusive licence to view and print pages from this website for your personal reference. You may not:
- Reproduce, copy, or distribute website content for commercial purposes without our written consent.
- Modify or create derivative works from any material on this website.
- Remove or obscure any copyright or attribution notice.
Documents and written summaries prepared for you as part of a service engagement are provided for your personal family use. They may not be shared commercially or repurposed without our consent.
6. Payment Terms
All fees are stated in Thai Baht (THB) and are inclusive of applicable taxes unless otherwise noted in your written service agreement.
- Payment timing: Payment is due prior to or at the commencement of the relevant service session, as confirmed in your service agreement.
- Payment methods: Bank transfer, cash, and other methods as communicated to you at the time of booking.
- Cancellation: Where a session is cancelled with less than 48 hours' notice, a cancellation fee of 50% of the session fee may apply. We will confirm the applicable cancellation terms in your service agreement.
- Adjustments: If a service engagement requires substantially more time or effort than originally anticipated, we will discuss any fee adjustment with you before proceeding.
We do not offer refunds once a session or service has been completed and the written outcome has been delivered to participants.
7. Service-Specific Terms
In addition to the general terms above, the following apply to each service category:
7.1 Family Mediation Session
The mediator's role is to facilitate conversation, not to decide outcomes or provide legal advice. All participants must attend voluntarily. The written outcome note is a record of discussions and understandings reached; it does not constitute a legally binding court order unless separately filed and approved by a competent court.
7.2 Sibling Caregiver Coordination
The shared care arrangement document we prepare is a private family document. It is not a substitute for legal guardianship or power of attorney instruments. Where formal legal instruments are required, we will advise you to seek independent legal counsel.
7.3 Multi-Party Family Settlement
The integrated settlement document is prepared to reflect the family's own decisions. It does not replace notarised deeds, court orders, or other formal instruments that may be required to give legal effect to specific arrangements. We will clearly indicate in the settlement document any matters that require separate formal action.
8. Disclaimers
This website and its content are provided for general information purposes. While we take care to ensure accuracy, we make no representation that all content is current or complete at the time you read it.
Our services are provided in good faith based on the information you share with us. We cannot predict or control the decisions reached by family members during mediation, and we do not warrant any particular family outcome.
Information on this website does not constitute legal advice. For matters requiring formal legal representation, please consult a qualified lawyer registered with the Lawyers Council of Thailand.
9. Limitation of Liability
To the fullest extent permitted by Thai law, mitsahax Advocates shall not be liable for:
- Any indirect, consequential, or incidental loss arising from your use of our website or services.
- Loss resulting from decisions made by family members during or after a mediation process.
- Temporary unavailability of this website due to maintenance or circumstances beyond our control.
- Force majeure events including natural disasters, civil disturbances, or public health emergencies.
Where liability cannot be excluded under Thai law, our total liability to you in connection with any single engagement shall not exceed the fees paid by you for that engagement.
10. Indemnification
You agree to indemnify and hold harmless mitsahax Advocates, its advocates, and staff from any claim, cost, or damage arising from your breach of these terms, your misuse of our website or services, or any false or misleading information you provide in connection with an engagement.
11. Termination
Either party may withdraw from a service engagement at any time before it has commenced, subject to the cancellation terms in Section 6.
We reserve the right to decline to continue an engagement where a participant acts in a manner that, in our professional judgement, makes continued mediation inappropriate or unsafe for any party.
Obligations relating to confidentiality, payment of outstanding fees, and intellectual property shall survive the end of any engagement or the termination of these terms.
12. Dispute Resolution
These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from them shall first be addressed through direct discussion between the parties.
If direct discussion does not resolve the matter within 30 days, the parties agree to attempt mediation before any formal legal proceedings are commenced.
If mediation is unsuccessful, disputes shall be submitted to the jurisdiction of the courts of Bangkok, Thailand.
13. General Provisions
- Entire agreement: These terms, together with the Privacy Policy and any written service agreement, constitute the entire agreement between us.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision of these terms at any time does not constitute a waiver of that provision.
- Assignment: You may not transfer your rights under these terms to another party. We may transfer our obligations where this does not affect the service provided to you.
- Notices: Formal notices should be sent to the address or email below.
14. Changes to These Terms
We may update these terms from time to time to reflect changes in our practice or applicable law. When we do, the revised date at the top of this page will be updated.
Where changes are material, we will take reasonable steps to draw your attention to them. Continued use of our website or services after changes have been published constitutes acceptance of the revised terms.
